These Terms of Use (“Terms”) govern your use of the Family Hertiage Realty website and services. By accessing or using our website, you agree to be bound by these Terms. If you do not agree, please discontinue use.

Terms of Use

 

Our Contract (E-SIGN)

 

You are entering a binding contract with Family Hertiage Realty LLC, the website www.fff, and the real estate professionals or lenders who use it and their parents, subsidiaries, and affiliates (the “Company,” “us,” “we,” and “our”).

 

By (1) using this website www.fff(“browse wrap”), and (2) by submitting your information to “Continue with Facebook” or “Sign Up!” and creating a user profile and clicking to agree to these Terms of Use and Privacy Policy (“click wrap”), you agree that you are giving your express written consent to all the terms below, as well as our Privacy Policy, both of which contain an Arbitration Agreement and Class Action Waiver.

 

You agree that your doing so constitutes your electronic signature and is equivalent to a written signature. You may choose to receive this contract on paper by calling us at 407.724.1789 or emailing us at millie.hernandez.realtor@gmail.com.

You may withdraw this consent by using the opt-out procedures described in the “Our Communications With You” section below.

 

By accessing www.fff, you are consenting to the information collection and use practices described in the Privacy Policy.

 

 

Our Communications With You (TCPA Consent for United States Residents)

 

Express Written Consent. By submitting your contact information, you are providing your express written consent to receive communications from us at the email address and telephone numbers you provide on our contact form, or that you later provide to us or enter into your contact page.

 

E-mails, Calls, and Texts. These communications may include telemarketing messages, delivered through email, landline, fax, cell phone, or text message (including SMS and MMS).

 

Autodialing. We may use an automatic telephone dialing system (or “auto-dialer”), which may include artificial or pre-recorded voices or “robotexts.” Your carrier’s standard rates and charges may apply.

 

No Purchase Necessary. Agreeing to these communications is not a condition of purchasing any property, goods, or services from us.

 

Revoking Consent and Opting Out. You may revoke your consent to receive communications at any time by replying “STOP” to any of our texts, or by any other reasonable means. Replying “STOP” will automatically revoke your consent to further text communications. For email communications, you may use the “unsubscribe” link provided in our emails. Other opt-out methods may take up to 30 days to process, but “STOP” and “unsubscribe” are immediate and recommended.

 

Communication Frequency. The frequency of communications may vary depending on the real estate professional who contacts you.

 

Your consent here also serves as your express written consent to electronic communications from us in the past.

 

You represent and warrant that:

 

• You are at least 18 years old.

• You live in the United States (or Canada, in which case Canadian consent provisions apply).

• You are not registered on a national or state Do Not Call list.

• You are the account holder for the provided email addresses and phone numbers, or you have authorization to provide them.

• The contact information you provide is accurate, and you will notify us if it changes.

 

Our mobile service may not be available in all states, and some features may not work with all carriers or devices. Contact your carrier with questions.

 

 

Additional Communications Provisions (For Residents of Canada)

 

In addition to the consent described above, Canadian residents agree to comply with Canada’s Anti-Spam Legislation (CASL), the Personal Information Protection and Electronic Documents Act (PIPEDA), and provincial laws including Alberta’s PIPA and Quebec’s privacy legislation.

Dispute Resolution – Arbitration Agreement (Mandatory Binding Arbitration and Class Action Waiver)

 

READ THIS SECTION CAREFULLY, AS IT AFFECTS YOUR LEGAL RIGHTS.

 

If a dispute arises, either you or we may elect binding arbitration rather than going to court. Arbitration allows an independent third party to resolve disputes without a judge or jury. By agreeing to arbitration, you waive your right to participate in a class action or jury trial.

 

Covered Claims. “Claim” means any claim, dispute, or controversy arising from or related to these Terms of Use, the Privacy Policy, your use of our website, your account, or communications with us.

 

Exclusions. Claims not subject to arbitration include disputes about the enforceability of this Arbitration Agreement, requests for temporary injunctive relief, and small claims court actions brought individually.

 

Administration. Arbitration will be conducted by either the American Arbitration Association (AAA) or JAMS, with a neutral arbitrator who is a licensed attorney with at least 10 years’ experience or a retired judge.

 

Class Action Waiver. Neither you nor we may participate in a class action, private attorney general action, or consolidated arbitration.

 

Location and Costs. Arbitration will be held at a location reasonably convenient to you. We will cover certain arbitration costs if required by law.

 

Your Right to Reject. You may reject this Arbitration Agreement by mailing a written rejection notice to:

Governing Law

 

These Terms of Use are governed by the laws of the State of Texas, without regard to conflict of law principles, except that the Arbitration Agreement is governed by the Federal Arbitration Act (FAA).

 

 

Disclaimer of Warranties and Limitation of Liability

 

This site is provided on an “as is” and “as available” basis. Davis Realty Services LLC and www.mikedavis.realtor make no warranties, express or implied, regarding the operation of this site or the accuracy of its content.

 

To the fullest extent permitted by law, we disclaim all warranties, including implied warranties of merchantability and fitness for a particular purpose. We are not liable for damages of any kind resulting from use of this site, including direct, indirect, incidental, punitive, or consequential damages.

 

 

Artificial Intelligence
